1. About these terms

These Terms of Service (“Terms”) govern your access to and use of blackwickguides.com and any digital product you buy from us (together, the “Services”). The Services are operated by BlackWick Guides.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to buy from us. By purchasing you confirm that you meet this requirement and that the payment details you provide are yours to use.

3. What we sell

We sell digital guides supplied as PDF files. There is no physical product and nothing is shipped. Delivery is electronic and immediate: after your payment is confirmed you receive access to your download. It is your responsibility to give a working email address at checkout and to download and save your file.

We are not responsible for delivery failures caused by a mistyped email address, a full mailbox, or a spam filter on your side — though if you tell us, we will re-send it.

4. Your licence to use the guides

When you buy a guide, we grant you a personal, non-exclusive, non-transferable, revocable licence to read and use it for your own purposes. We keep ownership of the guide and all copyright in it.

You may not: resell, rent, sub-licence or redistribute a guide in whole or in part; share, upload, post or torrent the file or its contents; reproduce it in your own paid or free product; use it to train a machine learning model; or remove any notice of ownership. One purchase covers one person.

If you breach this licence we may revoke your access without refund and pursue any remedy available to us.

5. Pricing and payment

Prices are shown in the currency displayed at checkout and may change at any time. Promotional pricing applies only while it is displayed, and we are not obliged to apply a past or future promotion to an order already placed. Payments are processed by our payment providers; we do not store your full card details. We may cancel or refuse any order we reasonably believe to be fraudulent.

6. All sales are final

Because our products are digital and delivered instantly, all sales are final and we do not offer refunds, exchanges or cancellations. Please read our Refund Policy in full before purchasing. Nothing in these Terms limits statutory rights that cannot lawfully be excluded.

7. No earnings guarantee

This is important, so we will be plain about it. Our guides are educational. They describe processes, tools and decisions that we or others have used. We do not promise, guarantee or imply any particular income, result, audience size or outcome.

Any figures, screenshots, testimonials, case studies or examples shown on our site, in our advertising or inside the guides are illustrations of what specific people reported at a specific time. They are not averages, not projections, and not a representation of what you should expect. Most people who buy an educational product do not replicate the results shown in its marketing.

What you achieve depends on your own effort, skill, judgment, niche, timing, budget, consistency and conditions entirely outside our control, including the policies and payout rates of third-party platforms. You accept full responsibility for decisions you make and money you spend after reading our materials.

8. Not professional advice

Nothing we publish is legal, financial, tax, accounting, investment, or business advice, and no relationship of adviser and client is created by your purchase. Consult a qualified professional licensed in your jurisdiction before making decisions with financial or legal consequences.

9. Third-party platforms

Our guides discuss third-party platforms and tools, including but not limited to YouTube, TikTok, Meta and various software and AI services. We are not affiliated with, endorsed by, sponsored by, or acting on behalf of any of them. Their names and marks belong to their owners. Their rules, terms, features, availability and payout rates can change at any time, and you are responsible for complying with the terms of any platform you use. We have no control over and accept no responsibility for a third party suspending, demonetising or terminating your account.

10. Acceptable use

You agree not to use the Services to break the law, infringe anyone’s rights, impersonate anyone, scrape or harvest data, interfere with or attempt to gain unauthorised access to our systems, or use any automated means to place fraudulent orders. We may suspend or terminate access for anyone who does.

11. Affiliates

If you take part in any affiliate or referral arrangement with us, you must describe our products truthfully, must not promise earnings on our behalf, must not use spam or misleading advertising, and must disclose your affiliate relationship as required by law. We may withhold commission and end the arrangement for any breach.

12. Availability

We aim to keep the Services available but do not guarantee uninterrupted access. We may change, suspend, or discontinue any part of the Services, including withdrawing a product from sale, at any time. Withdrawing a product does not affect guides you have already downloaded.

13. Disclaimers

To the fullest extent permitted by law, the Services and all products are provided “as is” and “as available” without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

14. Limitation of liability

To the fullest extent permitted by law, BlackWick Guides and anyone acting on its behalf will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profit, revenue, data, goodwill or business opportunity, arising out of or connected with the Services or any product, whether based in contract, tort, or any other theory, even if we have been advised of the possibility.

Where liability cannot lawfully be excluded, our total aggregate liability to you is limited to the amount you actually paid us for the product giving rise to the claim.

15. Indemnity

You agree to indemnify and hold harmless BlackWick Guides against any claim, loss, liability, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Services, or your infringement of any right of a third party.

16. Changes to these terms

We may update these Terms from time to time. The version published on this page at the moment you place an order is the version that governs that order. Continuing to use the Services after a change means you accept the updated Terms.

17. Governing law

These Terms are governed by the laws of the State of Ohio, United States, without regard to its conflict of law rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in Ohio, except where the consumer protection law of your own country or state gives you a right to bring proceedings elsewhere.

18. Severability

If any provision of these Terms is held unenforceable, that provision is limited or removed to the minimum extent necessary and the remaining provisions stay in full force.
